WIN FOR UNIONS: It looks like the ruling in controversial case Vergara v. California, the lawsuit filed by Students Matter in 2012 challenging teacher tenure and resulting unconstitutional inequities in the education of low-income students, has been overturned. The three-judge panel unanimously voted to reverse the 2014 Vergara v. California lower court ruling, pointing to a lack of evidence that minority students more frequently received ineffective teachers over other students. “This was a heavy burden and one plaintiffs did not carry. The trial court’s judgment declaring the statutes unconstitutional, therefore, cannot be affirmed," reads the decision papers.
