Primary functions of the position involve providinglegal advice and counsel to District administrators, and to serve as representative ofthe District or District’s interests in relation to various legal matters.MAJORRESPONSIBILITIES &REQUIREMENTS:• Responsible for handling of all litigation and claims involving the schooldistrict, including investigation, pleadings, discovery, motion practice, legalresearch, case file management, attendance at hearings, trial, appellatepractice, etc.• Coordinate litigation with legal counsel from outside law firms.• Monitors, assists, and acts as liaison in all legal and litigation mattershandled by outside counsel retained by the district.• Prepares and renders legal advice to Superintendent, AssistantSuperintendents and district administrative staff on various issues andinquiries; exercises independent judgment in the discharge of professionalresponsibilities in furtherance of the needs and interests of the District.• Reviews contracts and provides legal advice on the drafting of documents,rules and regulations, resolutions, contracts and agreements.• Advises district staff and coordinates compliance with regard to the TexasOpen Meetings Act and Texas Public Information Act requirements andinquiries.• Provides legal assistance in drafting of proposed legislation or Board ofTrustees policy.• Receives and responds to telephone inquiries from staff as related to legalissues.• Serves as the district's Coordinator for issues and claims arising under TitleIX of the Education Amendments pursuant to 34 CFR 106.8(a).JGConsulting |www.JGConsulting.us|AOne-FourthConsulting,LLCCompany• Coordinates responses to investigations by the U.S. Department ofEducation, Office of Civil Rights, Texas Education Agency, and other stateand Federal Agencies, including but not limited to the U.S. EqualEmployment Opportunity Commission• Responsible for handling claims, hearings and litigation related to SpecialEducation (or Coordination delegating the same to staff or outside counsel).• Assists in administrative hearings, grievance and employee disciplinarymatters, including termination and non-renewal hearings, primarily at theappellate level.• Responsible for writing, updating, and presenting Board policies andprocedures for adoption, and distribution of policies to staff.• Assists staff on development of discipline plans pertaining to student codeof conduct.• Coordinate the reporting of legal issues with State Board of EducatorCertification (SBEC).• Attends board meetings, other district, and district-related meetings at therequest of the Superintendent, and provides advice, updates on cases,opinions on liability, and other legal issues.• Conducts professional development training (including preparation oftraining materials) for designated district staff regarding school law issues,including but not limited to sexual harassment prevention training.• Attends continuing legal education seminars regularly to acquire andmaintain knowledge of pertinent areas of the law.• Prepares and submits quarterly or other periodic updates to keep theSuperintendent apprised of pending cases.• Prepares monthly report of legal expenses incurred by outside counsel andreviews, audits and monitors submitted billing statements.• Conducts periodic reviews of board policies, internal procedures, and stateand federal law to ensure district compliance.• Responsible for coordinating and overseeing timely compliance with studentrecord, employee record, and other types of subpoenas received by districtstaff.• Performs other related duties as necessary, as requested, or as assignedby the Superintendent.• Manages the budget and personnel; provides cost analysis of salary andwage adjustments for department budget. Prepares and administers a fiscalbudget concerning all operations of the Office of Legal Services andapproves requisitions within budget allocations, so as to ensure thatprograms are cost-effective and funds are managed prudently.• Assists in the publishing of the Employee and Student/Parent Handbooks.• Organizes training for Employees on Sexual Harassment or other policies.• Advises Human Resources in personnel matters.• Serves as the District’s representative in student and personnel matters andhearings before the Board of Trustees.Supervisory Responsibilities: The District Legal Counsel is administrativelyresponsible for the efficient and effective operation of the Offices of Legal Servicesand supervises and monitors supporting attorney(s), legal/administrative assistantsand/or secretaries assigned to the District's Office of Legal Services.
